Yesterday, the Mississippi Court of Appeals decided
McGrew v. Estate of McGrew located
here. The issue in the case was that a divorce was granted but the property division was not final. Before all the issues could be resolved, the husband died. After his death, the chancellor finished dividing the property and issued a final decree. The Court of Appeals reversed and rendered finding that the death of a party while the divorce is pending terminated the proceeding.
